Exploring Alternative Dispute Resolution: Paths to Effective Conflict Resolution
Tarunjeet Gujral is an experienced civil litigator with a strong track record of successfully resolving court cases on behalf of his clients. However, his expertise transcends the courtroom. A member of the Alternative Dispute Resolution Institute of Ontario and the Alternative Dispute Resolution Institute of Canada, Tarunjeet leads Gujral Law Professional Corporation with options to resolve disagreements and conflicts without the expense, stress, and other drawbacks of “going to trial.”
What is Alternative Dispute Resolution?
Our team in Mississauga may discuss ADR options with you, including negotiation, mediation, and arbitration. While the means to an end vary, each alternative is unified in its aim of solving disputes outside of the confines and processes of the courts. Whereas litigation has a “win” or “lose” outcome and highly systematic processes, ADR’s outcomes may be tailored to the parties’ needs, interests, and concerns. There is flexibility with regard to the ground rules agreed upon and adhered to throughout the process.
What is involved with negotiation?
Negotiation may be the first approach to consider, especially when resolving certain types of disputes (such as those over intellectual property). Discussions between the affected parties or counsel are held in the hope of reaching a mutually acceptable agreement. The negotiated agreement may become a final and binding contract enforceable by the courts. You and the other party also determine the process that results in the final agreement/contract.
How does mediation work?
In this process, an impartial third-party mediator like Tarunjeet Gujral facilitates communication between you and the other party. With this outside perspective and professional expertise, a dispute you cannot resolve on your own with the other party may finally be settled in a mutually satisfactory manner. Tarunjeet’s considerable expertise with ADR techniques helps you and the other party overcome any impasses or sticking points that may stand between you and achieve a successful and favourable resolution of a conflict. Acting as a neutral party, mediators encourage both “sides of the aisle” to consider the needs of the other and to solve problems creatively. Furthermore, mediators help enforce any agreement’s terms within specified deadlines.
How does arbitration differ from mediation?
The biggest difference between arbitration and mediation is that the mediator does not decide “right” or “wrong.” Rather, qualified mediators like Tarunjeet provide the guidance and insights to move the resolution process in the right direction—forward, helping the parties resolve and reach an agreement on their own through collaboration. He does not have decision-making control.
The arbitrator selected by you and the other party does have decision-making authority. While still a more cost-effective and quicker alternative to litigation, the arbitrator hears from all parties involved (and their witnesses), similar to a judge during a trial. A more formal process than mediation, the final and binding award is based on the arbitrator’s judgment and the conclusion rendered from evidence presented by parties/witnesses and applicable law.
Which option might be most appropriate for me?

ADR in general presents a cost-effective, fast, private, and less stressful way to preserve professional and business reputations and relationships. Second, recommendations for “next steps” are largely based on your current situation and the most pressing needs and issues. Factors that can influence our recommendations include:
- Complexity of your case
