3 steps to successful dispute resolution with professional mediation services
As a lawyer who retains membership in the Alternative Dispute Resolution Institute of Ontario and the Alternative Dispute Resolution Institute of Canada, Tarunjeet Gujral provides mediation services to help you avoid the considerable costs, stress, time, resources, and potential reputational damage associated with litigation. Gujral Law Professional Corporation has explored the benefits of alternative ADR approaches such as mediation on this website, and we welcome the opportunity to provide a glimpse into the process with those in Mississauga and across the GTA. Resolution of disagreements may be just three steps away.
1 – Pre-Mediation/Orientation
At this stage, the groundwork is laid for a successful mediation process. You and the other party/ies voluntarily agree to engage in the process with mutual transparency and respect. We will also encourage you to think about the issues as you perceive them and to consider how the other party may also perceive these key issues. It’s also helpful to consider solutions that might be satisfying for both you and the other party. At this step, an opening statement will be prepared that defines your rationale for the dispute and the reasons you want to move forward with mediation. Both parties will also be provided with information about specific rules and procedures to follow during this process.
2 – Mediation sessions
Consent to mediate will be formally signed. You and others involved will officially agree to establish ground rules. It is essential to actively contribute to finding options to resolve this dispute out of court. When in doubt at any point, ask questions and raise concerns promptly and civilly. Points to consider might range from needs, desires, and concerns to the issues that need to be resolved and creative solutions to those issues. As we work through mediation proceedings and meetings, these visits will culminate in a draft of settlement terms. You should not feel pressured to accept and sign the terms of settlement. Only agree to the settlement when you are comfortable with it. As a professional mediator, Tarunjeet Gujral will facilitate further discourse on any lingering or persistent concerns on your behalf until an amicable proposed agreement may be reached.
3 – Post-mediation
The terms and conditions established within the settlement will be implemented at this final phase of successful mediation proceedings. Within the agreement, deadlines will be set forth to ensure the terms of the settlement remain on track. Professional services help to support prompt compliance.
