Scale your expanding business with the Intra Corporate Transfer program

As an entrepreneur, there is nothing more satisfying than seeing all of that hard work come to fruition. We applaud those clients who have been in a position to grow their organizations beyond provincial or international borders. And at Gujral Law Professional Corporation in Mississauga, Ontario, we have had the great privilege of helping those organizations expand with services and guidance on meeting talent needs. And we have also aided in respective talent’s ability to expand their professional and personal horizons in our great country. Led by a seasoned business lawyer, Tarunjeet Gujral, our firm has facilitated these exciting transitions and expansions throughs its tie ups, via the Intra Corporate Transfer program.

Known technically as the “Intra-Company Transfer,” this pathway to living and working in Canada may be appropriate for some businesses who want to transfer existing employees outside of our borders to an established office within Canada or to those who are launching franchise operations. Those transferable organizations and employees essentially have a physical presence of some sort in Canada. Workers may be employed within a parent firm, at a branch or satellite office, or within subsidiaries and affiliates. To qualify, applicants do not need to work within their current arm or division of their potentially much larger, global organization. Additionally, Canadian law dictates that those who are awarded Intra-Company transfers are:

  • Executive, senior managers, or work within positions that demonstrate specialized knowledge.
  • Those with “specialized” knowledge have generally obtained advanced aptitude within the company’s respective services or products.
  • Be employees in some form for at least one year (out of the previous three years).

As noted previously, the eligible organization must abide by specific requirements; for the permit to be renewed, the firm must demonstrate continuous operations in Canada in the last year, and the Canadian branch or office must be staffed. The relationship between employee and employer must also be retained. As with other pathways to Canadian business ownership, work, and residency, there are specific requirements associated with the transfer program. This program is also exempt from stipulations related to other work and residency opportunities (i.e., exemption from Labour Market Impact Assessment requirements).

To navigate this process in the most efficient and stress-free way possible, contact Gujral Law Professional Corporation at (647) 957-8077 to schedule your consultation. Tarunjeet Gujral is knowledgeable of the latest on this program and related opportunities for your business and associates.
